1 Acceptance of Terms

By accessing or using VibeTraffic ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.

2 Description of Service

VibeTraffic provides website performance auditing and monitoring services, including:

• Website performance analysis using Google PageSpeed Insights
• SEO and technical health assessments
• Core Web Vitals monitoring
• Change detection and monitoring
• API access for automated testing

3 Account Registration and Security

3.1 Account Creation

To use our Service, you must create an account using a valid email address. You are responsible for maintaining the confidentiality of your account credentials.

3.2 Account Security

You are responsible for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.

4 Acceptable Use Policy

You agree to use the Service only for lawful purposes and in accordance with our Acceptable Use Policy.

5 Pricing and Payment Terms

5.1 Subscription Plans

We offer the following subscription plans:

• Free: 2 scans per day, 1 domain, 1 monitor
• Starter: $7/month - 200 scans per month, 3 domains, 5 monitors
• Pro: $19/month - 1,000 scans per month, 10 domains, 20 monitors, API access

5.2 Billing and Cancellation

Subscriptions are billed in advance on a monthly basis. You may cancel your subscription at any time through your account settings. Refunds are calculated on a pro-rated basis for unused portions of your subscription period. No refunds are provided for partial months; however, pro-rated credit may be applied to your account at our discretion.

5.3 Price Changes

We reserve the right to modify our pricing with 30 days' notice. Price changes will not affect your current billing period.

6 Service Availability

We provide the Service on a "best effort" basis. While we strive to maintain high availability, we do not guarantee uninterrupted service and reserve the right to:

• Suspend service for maintenance or updates
• Modify or discontinue features with reasonable notice
• Implement usage limits to ensure fair access

7 Intellectual Property Rights

7.1 Our Content

The Service and its original content, features, and functionality are owned by Z MARIN and are protected by international copyright, trademark, and other intellectual property laws.

7.2 Your Content

You retain ownership of any content you submit to the Service. By using the Service, you grant us a limited license to process and analyze your content solely for the purpose of providing our services.

8 Limitation of Liability

You agree to defend, indemnify, and hold harmless Z MARIN from and against any claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including attorney's fees) arising from your use of the Service or violation of these Terms.

10 Termination

10.1 Termination by You

You may terminate your account at any time by canceling your subscription through your account settings or contacting us.

10.2 Termination by Us

We may terminate or suspend your account immediately, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason.

11 Force Majeure

We shall not be liable for any failure or delay in performance under these Terms which is due to fire, flood, earthquake, elements of nature or acts of God, acts of war, terrorism, labor disputes, or any other cause which is beyond our reasonable control.

12 Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes via email or through the Service. Your continued use of the Service after such modifications constitutes acceptance of the updated Terms.

13 Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of Croatia, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts of Split, Croatia.

14 Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

15 Entire Agreement

These Terms, together with our Privacy Policy and Acceptable Use Policy, constitute the entire agreement between you and Z MARIN regarding the use of the Service.
